These Terms of Service ("Terms") govern your access to and use of the Trailerfade mobile application, website, community services, mapping tools, cloud services, and related features (collectively, the "Services").
By accessing or using Trailerfade, you agree to be bound by these Terms. If you do not agree with these Terms, do not use the Services.
Trailerfade is an outdoor recreation and ecological awareness platform designed to encourage respectful, low-impact hiking through sound-awareness, route tracking, gamification, environmental education, and community engagement.
Trailerfade promotes a biocentric approach to outdoor recreation, encouraging users to reduce their acoustic impact on natural environments.
Trailerfade was created and developed under the direction of Prof. Erik Geslin.
You must be at least 13 years old to use Trailerfade. If you are under the age required by your local jurisdiction, a parent or legal guardian must consent to your use of the Services. You are responsible for ensuring that your use of Trailerfade complies with local laws.

Trailerfade may analyze environmental sound levels in order to provide features such as Invisibility Score, Trail Points, acoustic awareness indicators, and environmental event markers.
These metrics are educational and recreational tools. They are not scientific measurements, certifications, or guarantees of ecological impact. Scores are estimates generated through software models. Trailerfade makes no claim that any score accurately represents actual disturbance to wildlife.
Trailerfade may access your device microphone during active hiking sessions. Audio processing is designed to analyze environmental sound characteristics. Trailerfade does not intentionally record conversations for playback or surveillance purposes. Audio analysis is intended solely to support application functionality.
Users remain responsible for complying with local laws concerning audio recording and privacy.
Trailerfade may collect location information during active use. Location data may be used to:

Users may submit profile information, hike data, comments, photographs, and community content. You retain ownership of your content. By uploading content, you grant Trailerfade a non-exclusive, worldwide license to host, display, process, and distribute such content solely for operation of the Services. You represent that you have the necessary rights to submit such content.
Trail Points, badges, achievements, rankings, and scores are virtual elements provided for entertainment and educational purposes. They have no monetary value, cannot be redeemed for cash, and do not constitute property rights. Trailerfade may modify scoring systems, achievements, or reward structures at any time.
Trailerfade may offer merchandise through its website or affiliated storefronts. Products may include apparel, mugs, accessories, outdoor equipment, and branded merchandise. Purchases are subject to applicable payment provider terms, shipping policies, and return policies. Trailerfade reserves the right to modify product offerings at any time.
Trailerfade may rely on third-party services, including but not limited to OpenStreetMap, Leaflet, Stripe, Supabase, cloud hosting providers, and analytics providers. Trailerfade is not responsible for the availability, accuracy, or policies of third-party services. Your use of those services may also be governed by their respective terms.
The Trailerfade name, logos, branding, visual assets, software, design elements, and associated intellectual property are protected by applicable laws. The Trailerfade concept, branding, and associated materials remain the property of Trailerfade and/or their respective rights holders. You may not copy, redistribute, reverse engineer, reproduce, or exploit any part of the Services without permission.
Trailerfade promotes ecological awareness and a biocentric perspective. The views expressed within educational materials are intended for informational and philosophical discussion. Nothing within Trailerfade should be interpreted as scientific, legal, medical, or environmental policy advice.
The Services are provided "AS IS" and "AS AVAILABLE." To the fullest extent permitted by law, Trailerfade disclaims all warranties, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability. Trailerfade does not guarantee that the Services will always function correctly or remain error-free.
To the maximum extent permitted by law, Trailerfade, its creators, contributors, affiliates, employees, contractors, and partners shall not be liable for personal injury, property damage, lost data, lost profits, indirect damages, incidental damages, outdoor accidents, wildlife encounters, or navigation errors arising from use of the Services. Your use of Trailerfade is entirely at your own risk.
You agree to defend and indemnify Trailerfade against claims arising from misuse of the Services, violation of these Terms, violation of applicable laws, or infringement of third-party rights.
Trailerfade may suspend or terminate access to the Services at any time if these Terms are violated, illegal activity is suspected, or system security is threatened. Users may stop using the Services at any time.
Trailerfade may update these Terms periodically. Updated versions will be posted through the website and/or application. Continued use after updates constitutes acceptance of the revised Terms.
These Terms shall be governed by the laws applicable in the jurisdiction where Trailerfade is operated, without regard to conflict-of-law provisions. Where required by applicable law, consumers may retain additional rights under their local jurisdiction.
